5. Withdrawal from the contract
A consumer-buyer has the right to withdraw from the purchase contract without giving any reason within 14 days of receiving the goods, in accordance with § 1829 (1) of the Czech Civil Code.
The buyer may withdraw using any of the following:
- The electronic withdrawal function — a form available directly in the online shop on Returns and Refunds;
- By e-mail to eshop@spokar.com;
- By post to the return address stated in this article below.
Withdrawal must be sent to the seller within the above 14-day period. A model form is available on Returns and Refunds; its use is not mandatory. The seller will confirm receipt of a withdrawal made via the electronic function or e-mail without undue delay on a durable medium (usually by e-mail).
The buyer must return the goods to the seller within 14 days of withdrawal, to the address SPOKAR a.s. – E-SHOP, Libkovodská 1428, 393 01 Pelhřimov, Czech Republic. The cost of returning the goods is borne by the buyer. Goods cannot be sent cash-on-delivery; such parcels will not be accepted.
The seller will refund all funds received from the buyer, including delivery costs corresponding to the cheapest delivery method offered, within 14 days of withdrawal, using the same payment method. The seller is not obliged to refund the funds before the buyer hands over the goods or proves that the goods have been sent back (§ 1832 (4) of the Czech Civil Code).
The buyer is liable for any diminished value of the goods resulting from handling them in a manner other than necessary given their nature and properties (§ 1833 of the Czech Civil Code); the refund may be reduced accordingly.
Exception: Under § 1837 of the Czech Civil Code, the buyer cannot withdraw from a contract for goods in sealed packaging that the consumer has unsealed and which cannot be returned for hygiene reasons (an opened toothbrush in unsealed hygienic packaging).
6. Rights from defective performance (warranty claims)
The consumer-buyer may exercise rights from a defect that appears in consumer goods within 24 months of receipt. The seller will handle a claim without undue delay, no later than 30 calendar days from the date the claim is filed. Procedure: Returns and Refunds.
